General Terms of Use of Afterlife Horizon Online

These texts are drafted in French and are also offered to you in English. If the two versions differ, the version that is most favourable to you applies.

English translation of the French version 0.9.

Version 0.9, in force as of 13 October 2026, during the Alpha.

The essentials in ten points

This summary helps you read the terms; it does not replace them. In case of doubt between the summary and an article, the interpretation most favourable to the Player applies.

  1. These terms are the contract between you and the Publisher for the whole Service: the Site, the Launcher, the Game, its chat, your Account and support. The Code of Conduct will supplement them.
  2. You must be at least 15 years old to have your own Account; under 15, a child only plays on the Account of one of their parents. Donations are reserved for adults.
  3. Your Account is personal: you do not lend it, share it or sell it.
  4. Afterlife Horizon Online is a game of combat between players: according to the rules of the Game, your ship may be destroyed by other players. That is the game, not a defect.
  5. Cheating, software that distorts the game, the exploitation of bugs and the sale of accounts or items for real money are prohibited.
  6. Any sanction is decided by a person, never by a machine alone; it is explained to you and you can challenge it.
  7. Anyone, player or not, can report illegal content to us.
  8. During the Alpha, the Game is a test version: it may be interrupted, and your progression may be reset.
  9. If we change these terms significantly, we notify you in advance and you can leave free of charge.
  10. In the event of a dispute, write to us first; you can bring the matter before the court of your domicile, and you keep the protection of the law of your country.

Article 1 — The Publisher and the purpose of these terms

1.1 The Service is published and operated under the name “Reloaders”, which can be contacted at support@afterlife-game.com (the “Publisher”). Until the company Reloaders is registered, the Publisher is the creator of the Game, a natural person who operates it on a non-professional basis; as soon as it is registered, the company takes the creator's place (article 22.4). The other information about the Publisher and about the host of the Service appears in the legal notice of the Site.

1.2 These general terms of use (the “Terms of Use”) set the rules for access to the Service and for its use: the Site, the Launcher, the Client, the Game, the Game chat, the Account, support and the Alpha. They apply to each Player from the creation of their Account or their first use of the Service, whatever the means of access (the Launcher today; a distribution platform tomorrow, article 22.5).

1.3 During the Alpha, no purchase is offered (donations: article 8.3). When the shop exists, each purchase will also be governed by the general terms of sale.

Article 2 — Definitions

In the Terms of Use, the following words, written with a capital letter, have the meaning set out here. They have the same meaning in all the documents of the Publisher cited in article 3.

TermMeaning
PublisherThe person who publishes and operates the Game and the Service under the name “Reloaders”, who can be contacted at support@afterlife-game.com (article 1.1).
GameThe massively multiplayer online video game “Afterlife Horizon Online” (called “Nebula” during the Alpha), with its updates and its servers.
ServiceEverything that the Publisher provides around the Game: the Game, the Software, the Site, the Account, the Game chat, support and, once it exists, the shop.
AccountThe personal account, created with an email address and a password, that gives access to the Service.
PlayerAny natural person who creates an Account or uses the Service. A Tester is a Player.
TesterA Player admitted to the Alpha by means of a personal Access Key, who has accepted the test agreement.
ContentAny information that a Player provides or publishes by means of the Service: username, chat messages, guild or preset names, reports, test feedback, screenshots and videos. The elements created by the Publisher (graphics, sounds, texts, universe) are not Content: they are the “Game elements”.
Virtual ItemAny Game element that the Player obtains by playing or, once the shop exists, by purchasing it (ship, equipment, resource, appearance…), which the Player may use in the Game under a personal licence and which has no monetary value outside the Game.
Virtual CurrencyA unit of account specific to the Game (currently the “credits” earned by playing; in the future, where applicable, a purchased currency), usable only in the Game to obtain Virtual Items or Game services. It is neither legal tender nor electronic money, and it cannot be converted into money, except in the cases provided for by law and by the terms of sale.
SiteThe websites https://afterlife-game.com and https://spacefate.com, and their public subdomains.
LauncherThe Windows software of Afterlife Horizon Online (the file “NebulaLauncher.exe”) that creates the Account, signs the Player in, and installs, updates and launches the Client.
ClientThe Game software installed on the Player's computer.
SoftwareThe Launcher and the Client, together.
AlphaThe test phase of the Game, free of charge and by invitation, which precedes its opening to the public. Paid early access (for example on Steam) is not the Alpha: it falls under the terms of sale.
Access KeyThe personal code provided by the Publisher that opens the Alpha to an Account.
General Terms of Use (“Terms of Use”; in French, “CGU”)The contract that governs access to the Service and its use, concluded between the Publisher and each Player; the Code of Conduct forms part of it.
Code of ConductThe document that states what is prohibited in the Service and in the Official Community Spaces, the possible Moderation Measures, Reports and challenges; it forms part of the Terms of Use.
Moderation MeasureAny decision that the Publisher takes because Content is illegal or contrary to the Terms of Use, or because a Player does not comply with them: a reminder of the rules, removal or hiding of Content, muting in the chat, a username to be changed, removal of Virtual Items or Virtual Currency obtained illegitimately, suspension or closure of the Account, withdrawal of access to the Alpha.
Illegal ContentAny information that is contrary to the law of the European Union or to the law of a Member State (Regulation (EU) 2022/2065, the Digital Services Act, article 3(h)).
ReportThe message by which any person, Player or not, points out to the Publisher Content that they consider illegal or contrary to the Terms of Use (the “notice” referred to in article 16 of the Digital Services Act).
Official Community SpacesThe online spaces that the Publisher administers outside the Service, such as the Discord server of the Game; they also remain subject to the terms of the platform that hosts them.

Article 3 — The documents that form the contract

3.1 The contract between you and the Publisher consists of:

  1. these Terms of Use. The Code of Conduct, which will detail what is prohibited, the Moderation Measures and how to challenge them, will form part of them as soon as it has been presented to you and you have accepted it with a new version of the Terms of Use; until then, articles 9 to 12 apply alone;
  2. the end user licence agreement, which authorises you to install and use the Software, and which you accept with the Terms of Use when the Launcher is first launched;
  3. if you are a Tester, the Alpha testers' agreement, as soon as it has been presented to you and you have accepted it;
  4. if you make a purchase, the general terms of sale in force on the day of your order.

3.2 The privacy policy, published on the Site, informs you of the use of your personal data; Annex A of the licence agreement, of the information that the Software records on your device. These are not clauses that you accept: you can read them at any time.

3.3 Each document applies to its own field: the licence to the Software, the testers' agreement to the Alpha, the general terms of sale to purchases, the Terms of Use to everything else. If two documents contradict each other, or if a clause is ambiguous, the interpretation most favourable to the Player prevails.

3.4 No other text (a message on a forum, an announcement on Discord, a help page) imposes an obligation on you if it is not cited here and accepted by you. Conversely, the commitments that the Publisher or the persons acting on its behalf make to you remain owed.

Article 4 — Acceptance, proof and versions

4.1 The Launcher presents the Terms of Use to you, together with the licence agreement, the first time it is launched on your computer, then at each new version of either of these texts. You accept them by clicking “I accept”, after having been able to read them. Without this acceptance, the Launcher does not let you create an Account, sign in or play.

4.2 Upon simple request to support@afterlife-game.com, the Publisher sends you the Terms of Use in force and their previous versions, with their dates, in a format that you can save and print; they will also be published on the Site.

4.3 The Launcher keeps a record of your acceptance on your computer: the number of the version accepted, its digital fingerprint, which identifies the exact text, and the date and time of the acceptance.

4.4 If you were already using the Launcher before the entry into force of this version, this version is presented to you at the next start-up of the Launcher, and you accept it in the same way. If you do not accept it, you can no longer use the Launcher or play; you can still obtain a copy of your data and the deletion of your Account by writing to support@afterlife-game.com.

Article 5 — Who may use the Service

5.1 Minimum age. You must be at least 15 years old to use the Service with your own Account. We do not open an Account in the name of a child under 15, even with the consent of a parent: before that age, a child only plays on the Account of one of their parents (article 6.3). By accepting the Terms of Use, you declare that you are at least 15 years old. We do not ask you for any identity document.

5.2 Money is reserved for adults. Donations (article 8.3) and, later, the shop are reserved for adults: 18 years old, or the age of majority of your country if it is higher.

5.3 If you are a minor (from 15 years old until you come of age). The whole Game is open to you; donations are not intended for you. Talk to your parents about this game: they can ask us at any time to close your Account and to erase your data, by writing to support@afterlife-game.com.

5.4 One Account per person. Unless the Publisher agrees otherwise in writing, a single person holds only one Account.

5.5 After a closure. A person whose Account has been closed for a serious breach may not open another one for one year, unless the Publisher agrees.

5.6 If the declared age is false. We rely on your declaration: we cannot verify it. If we learn that an Account is held by a person under 15, we notify that person, then we close the Account and erase its data, after having given that person 30 days to request a copy; one of their parents may open an Account in the parent's own name (article 6.3). If an Account has been opened in disregard of articles 5.4 or 5.5, the Publisher may suspend it; it informs you and explains how to regularise the situation or to recover a copy of your data. A false declaration does not deprive you of any of the rights that the law gives you.

Article 6 — Your Account

6.1 Creation. You create your Account from the Launcher, with an email address that you use and a password. Provide accurate information: the Publisher uses this address to write to you about the security of your Account, the modifications of the Terms of Use and Moderation Measures.

6.2 Security. Keep your password secret and do not use the same one elsewhere. The Launcher allows you to enable two-factor authentication: we recommend it. If you think that another person is using your Account, let us know without delay at support@afterlife-game.com and change your password through “Forgot your password?”. To protect an Account that appears to be compromised, the Publisher may block it temporarily; it informs you and helps you regain control of it.

6.3 A personal Account. You do not lend, share, rent, sell, give or buy an Account, or access to an Account, and you do not use the Account of another person, even with their consent. A single exception: if you are a parent, or if you exercise parental authority, you may let your minor child play on your Account, in your place — one child per Account. The Account remains yours: you accept these terms for yourself and for your child, and you are responsible for what is done on it, within the limits provided for by law.

6.4 Who is responsible for the use of the Account. You are responsible for what is done with your Account when it results from your own act, for example if you have communicated your password. You are not responsible for a fraudulent use that you could not prevent, in particular after having informed us that your Account was compromised.

6.5 Your username. You choose a username, which the other Players see. It has 3 to 20 characters: letters without accents, digits, hyphen and underscore. It is unique, regardless of upper and lower case. Names that imitate the team or the Game (“admin”, “modo”, “support”…) are refused, and the Code of Conduct applies to all names. You can change your username once every 90 days. A username that becomes contrary to these rules is displayed as “Pilote” to the other Players, and you may be invited to choose another one.

6.6 Your data. From the Launcher, you can export your data and delete your Account at any time (article 13.2 and privacy policy); if the Launcher is closed to you (article 4.4), write to support@afterlife-game.com.

Article 7 — What the Service provides

7.1 The Game. Afterlife Horizon Online is an online space combat video game, massively multiplayer, in a persistent universe that all the Players share. It is played only online, on a computer running Windows, with an Internet connection, an Account and the Launcher. It is under development: its content, its rules and its balance evolve (article 14).

7.2 Combat between players. According to the rules of the Game, a Player may attack another. Your ship may be destroyed, and you may lose Virtual Items or Virtual Currency, as a result of the actions of other Players or of the rules of the Game. These losses are part of the Game as it is described here: they are neither a defect of the Service nor damage for which the Publisher is liable. It is otherwise if the loss results from a malfunction of the Service, from a breach by the Publisher or from a fraud contrary to the Code of Conduct: the Publisher then restores, as far as possible, what was lost, without prejudice to your other rights.

7.3 The Game chat. The Game includes a sector chat, read by the Players present in the same sector, and private messages between two Players. It is not open yet; the rules that concern it will apply as soon as it opens. There, you will be able to block a Player and to report a message. The messages are kept for the period indicated by the privacy policy. During the Alpha, the exchanges between the Client and the servers of the Game are not encrypted: do not write any confidential information in the chat (password, contact details, bank details).

7.4 Availability. The Publisher makes its best efforts for the Service to be accessible, without being able to guarantee that it will be so without interruption or error. It may interrupt it for maintenance, an update, security, or following an incident. It announces planned interruptions in advance whenever it can, through the Official Community Spaces, the Launcher or the Site. During the Alpha, interruptions may be frequent (article 8).

7.5 Updates. The Launcher updates itself and installs the updates of the Client. To sign in, you must use the up-to-date version. The updates necessary for the proper functioning of the Service are provided to you free of charge; the licence agreement sets out their rules.

7.6 What remains at your expense. The hardware, the Internet connection and their costs. The recommended configuration will be published on the Site.

Article 8 — The Alpha

8.1 Access. The Alpha is closed: it is open by invitation. The Publisher gives each Tester a personal Access Key, which may be neither transferred nor shared. The Alpha testers' agreement, which will supplement the Terms of Use, will be presented to you for your acceptance. The Publisher may withdraw a Tester's access to the Alpha, without closing their Account.

8.2 A test version. The Alpha is used to test the Game. What you see there is not final. Expect bugs, interruptions, changes of balance and resets of progression, of Virtual Items and of Virtual Currency. The Publisher announces them in advance whenever it can.

8.3 No purchase; donations. Nothing is sold during the Alpha. What is obtained there has value only for the Alpha, except what the Publisher announces as kept. The donations that you can make to support the development of the Game, through the links that the Publisher publishes, go through third-party platforms (PayPal, Buy Me a Coffee) that have their own terms: they are not purchases, they are not linked to your Account, and they are reserved for adults (article 5.2). If a minor has made a donation, one of their parents can write to us at support@afterlife-game.com with the date and the amount of the donation: it is returned.

8.4 Confidentiality. What you discover during the Alpha and that is not public is confidential: do not disseminate it without the consent of the Publisher. The testers' agreement will set its conditions and duration. If you are a minor, this is a request that we make to you, not a commitment that legally binds you.

8.5 The end of the Alpha. The Alpha ends on a date that the Publisher announces at least thirty days in advance, except for an overriding reason (security, legal obligation). On that occasion, it states what the Testers keep (for example their Account, their username, a Tester reward). A Tester's access may also end earlier, at their request or by a Moderation Measure.

Article 9 — Your commitments

By using the Service, you undertake to:

  1. comply with the law, the Terms of Use, the Code of Conduct, the licence agreement and, if you are a Tester, the testers' agreement;
  2. play fairly: no cheating, no software or hardware that distorts the Game or plays in your place, no deliberate exploitation of a bug;
  3. report the bugs and the vulnerabilities that you discover, without disclosing them;
  4. neither sell nor buy anything from the Service for real money or for an advantage outside the Game (Account, Virtual Items, Virtual Currency, progression, services rendered in the Game);
  5. not harm the Service or those who operate it (intrusion, deliberate overloading, disruption, automated extraction of data);
  6. respect the other Players and the team of the Publisher.

The details, with examples and the possible Moderation Measures, will appear in the Code of Conduct.

Article 10 — Your Content

10.1 You remain the holder of the rights that you have in your Content.

10.2 For the Service to work, you grant the Publisher, free of charge, worldwide and on a non-exclusive basis, the right:

  1. to reproduce your Content on its servers and in its backups;
  2. to represent it, that is to say to display it to the Players for whom you intend it (your username above your ship, your messages to their recipients, the name of your guild…);
  3. to keep and examine it in order to moderate the Service, to process Reports and challenges, and to respond to the requests of authorities;
  4. to adapt it only to the extent technically necessary (format, length, permitted characters).

This right applies for the retention period of each Content set by the privacy policy, and ends with it. It allows neither the sale of your Content nor its use in an advertisement: any other use, for example a screenshot showing your username in a trailer, requires your separate consent.

10.3 Your ideas. The ideas, suggestions and feedback that you send to the Publisher — including your test feedback during the Alpha, as long as the testers' agreement does not govern them otherwise — may inspire it freely: an idea belongs to no one. The Publisher is under no obligation either to use them or to pay you. If your submission contains an original creation (a text, an image), you grant the Publisher over it, free of charge and on a non-exclusive basis, the right to reproduce it and to adapt it in order to improve the Game, worldwide and for the duration of the rights.

10.4 Your moral right over your creations (respect for your name and for your work) cannot be assigned: nothing in the Terms of Use deprives you of it.

10.5 You guarantee that your Content does not infringe the rights of others and is not Illegal Content. The Publisher may remove it or restrict its visibility under the conditions of article 11 and of the Code of Conduct.

Article 11 — Moderation: our rules, our tools, our decisions

11.1 What is prohibited. The restrictions that the Publisher imposes on your Content and on your behaviour are those of article 9; the Code of Conduct will detail them: Illegal Content, harassment, cheating, exploitation of bugs, trade for real money, attacks on the Service.

11.2 How the Publisher learns that a rule has been broken:

  1. through a Report, which any person may send it, Player or not, at the address of article 20;
  2. through its own findings, when its team plays, examines a Report or consults the technical logs of the Service;
  3. through the alerts of the automated tools described in 11.3.

11.3 The automated tools and what they do. The Service applies automated rules that prevent certain abuses at the moment they are attempted, without judging anyone:

  • the username: only certain characters are accepted, from 3 to 20, and names that imitate the team or the Game are refused;
  • the chat, as soon as it opens: a message has 200 characters at most; certain characters are refused (formatting tags, invisible characters, emojis); the number of messages is limited over time (for example, 5 messages in 10 seconds); the messages of a Player that you have blocked are not delivered to you;
  • the Game: checks carried out on the servers verify certain data sent by your Client, such as the speed or the movements of your ship; they may discard impossible data or report an anomaly to the team.

None of these tools takes a Moderation Measure against a Player: they refuse an action at the moment it is attempted, or report an anomaly to a person.

11.4 Who decides. Any Moderation Measure that targets a Player or Content is decided by a person designated by the Publisher, after an examination of the facts; none is taken by an algorithm alone. This person accesses the moderation tools with two-factor authentication.

11.5 How. The Publisher acts with diligence, objectivity and proportionality, taking into account the rights of each person and in particular freedom of expression: criticising the Game or the Publisher is not a fault. It chooses the least severe Measure that is sufficient to stop the breach, according to its seriousness, whether or not it was deliberate, repetition and its effects on the other Players. The Code of Conduct will publish an indicative scale.

11.6 The statement of reasons. Each Moderation Measure is notified to you with a statement of its reasons: the facts, the rule concerned, its duration, and how to challenge it.

11.7 Challenging a decision. You may challenge, free of charge and electronically, any moderation decision that concerns you — including the decision taken on a Report that you made — within six months following its notification, by writing to support@afterlife-game.com. A person re-examines the whole file; their reply, with reasons, reaches you within thirty days at most and states whether the decision is maintained, modified or cancelled. In all cases, you keep your recourse to the courts (article 21).

11.8 The authorities. The Publisher promptly informs the competent authorities when it becomes aware of information giving rise to a suspicion of an offence that threatens the life or safety of persons, as well as of the illegal activities that the law requires it to report to them. It responds to the orders and requisitions of the authorities under the conditions provided for by law.

Article 12 — The Moderation Measures

12.1 The possible Moderation Measures range from a reminder of the rules to the closure of the Account (article 2); their indicative scale will appear in the Code of Conduct. They may target Content, the use of the chat, Virtual Items or Virtual Currency obtained illegitimately, access to the Alpha or the Account.

12.2 Gradation. Except in the case of a serious breach, the Publisher starts with the lightest Measure that is sufficient, and makes it stricter in the event of repetition.

12.3 Precautionary suspension. In the event of a serious suspicion of a serious breach (intrusion, fraud, organised cheating, threat to the safety of other persons), the Publisher may suspend the Account as a precautionary measure, for the time needed to check, for seven days at most, renewable once with notice to you. The suspension is lifted without delay if the suspicion is not confirmed. It is notified to you with its reasons, like any Measure.

12.4 Effects. During a suspension, you can no longer connect to the Game; your data, your Virtual Items and your Virtual Currency are kept, except those that the Measure removes because they were obtained illegitimately. The closure of the Account ends the contract and the licence; your data is then processed as provided for in the privacy policy. The effects of a Measure on your purchases are governed by the general terms of sale.

Article 13 — Term and end of the contract

13.1 Term. The contract is concluded for an indefinite term, from the creation of your Account.

13.2 You may terminate it at any time, free of charge and without giving a reason, by deleting your Account from the Launcher (“Delete my account”; your password is requested) or by writing to support@afterlife-game.com. Your game data is then erased, then your Account, within the time limits indicated in the privacy policy. The Virtual Items and the Virtual Currency of your Account disappear with it; your rights over what you may have paid for are governed by the general terms of sale.

13.3 The Publisher may terminate it for a serious breach, by closing your Account — organised cheating, intrusion, fraud, threat to other persons, or repetition after a Moderation Measure, and the other cases that the Code of Conduct will designate —, with a statement of reasons and the possibility of challenging it.

13.4 The Publisher may also terminate it without fault on your part, for example if it stops the Service, by notifying you by email at least sixty days in advance. What you may have paid in advance for a service that will not be provided is refunded to you, as provided for in the general terms of sale.

13.5 Inactivity. The Publisher does not close inactive Accounts. If it decided to do so, it would announce it by a modification of the Terms of Use (article 14) and would notify each Player concerned at least sixty days before any closure, telling them how to keep their Account.

13.6 Discontinuation of the Game. If the Publisher discontinues the Game, it announces it at least sixty days in advance, on the Site, in the Launcher and by email, indicating the date of discontinuation, what happens to the Accounts and the data, and the refunds due.

13.7 What survives. Articles 10 (for the remaining retention period), 15 and 21 continue to apply after the end of the contract, as does the confidentiality of the testers' agreement for the duration that it sets.

Article 14 — Evolution of the Service and of the Terms of Use

14.1 The Service evolves. The Publisher may modify the Game and the Service for one of the following valid reasons: correcting a bug or a vulnerability; combating cheating and abuse; balancing the Game; adding, replacing or removing content or features as part of development; adapting to a technical change (hardware, system, security); complying with the law or with the decision of an authority; during the Alpha, testing the Game. These modifications are free of charge for you.

14.2 If a modification reduces your access to the Service or its use in a more than minor way, the Publisher informs you of it clearly, by email and at least thirty days in advance, except in a security emergency or under a legal obligation. You may then terminate the contract free of charge within 30 days following this information, or the modification if it is later, and obtain the refund provided for by the general terms of sale.

14.3 The Terms of Use evolve. The Publisher may modify the Terms of Use for one of the reasons of article 14.1 or to follow the evolution of the Service. For any significant modification, it informs you at least thirty days before its entry into force, by email or in the Launcher, with a summary of the changes; the new version is presented to you at the next start-up of the Launcher, and you accept it or terminate the contract free of charge. A modification without consequence for you (a typo, a contact detail) is published with the date of the new version. A modification imposed urgently by the law or by security may apply earlier; the Publisher then explains the reason to you.

14.4 A modification of the Terms of Use never changes the conditions of a purchase already made, nor the term of the contract, nor the price of a service in progress, outside the cases that the law permits.

14.5 All the versions of the Terms of Use, with their dates, remain available upon simple request, and will be published on the Site.

Article 15 — Liability

15.1 The Publisher is liable, under the ordinary rules of law (droit commun), for the damage that it causes you by not performing its obligations or by performing them badly. It is not liable when the damage is due to your own act, to the unforeseeable and irresistible act of a third party unconnected with the Service, or to a case of force majeure within the meaning of article 1218 of the French Civil Code (Code civil).

15.2 Nothing in the Terms of Use limits the liability of the Publisher in the event of bodily injury, of gross negligence (faute lourde) or of intentional misconduct (faute intentionnelle), nor deprives you of the legal guarantees (article 16).

15.3 You are liable, under the ordinary rules of law, for the damage that you cause to the Publisher or to other persons by not complying with the Terms of Use or the law.

15.4 The services of third parties that you use with the Service (Discord, a distribution platform, your Internet access provider) fall under their own terms; the Publisher is not liable for their operation. It is, on the other hand, liable for the service providers that it chooses to provide the Service in its place (hosting, sending of emails) as for itself.

Article 16 — Legal guarantees

16.1 When you have paid a price or provided another consideration, the digital content and services of the Service benefit from the legal guarantee of conformity (garantie légale de conformité) provided for by the French Consumer Code (code de la consommation) (articles L224-25-1 et seq.). The general terms of sale set it out in detail.

16.2 The deviations specific to the Alpha (bugs, interruptions, resets) are described in article 8; the testers' agreement will describe them in detail and will have you accept them expressly and separately.

Article 17 — Intellectual property

17.1 The Game, the Software, the Site and the Game elements (universe, graphics, sounds, texts), as well as the names and logos “Afterlife Horizon Online” and “Nebula”, belong to the Publisher or to those who have granted it the right to use them. The licence agreement sets out what you may do with the Software. Any other use requires the written consent of the Publisher.

17.2 Screenshots, videos and live streams. Outside the Alpha, whose confidentiality is governed by article 8.4, you may make and publish screenshots, videos and live streams of your play sessions, including on platforms that pay you through advertising, donations or subscriptions, provided that you:

  1. do not give the impression that the Publisher supports you or has given you a particular authorisation;
  2. do not sell access to this content, nor the Game elements themselves;
  3. do not distort the Game or its names and logos;
  4. comply with the Code of Conduct.

The Publisher may withdraw this authorisation from a person who does not comply with these conditions, telling them why.

17.3 The Publisher objects to the automated extraction of data and elements of the Service, including for the purposes of text and data mining or of training artificial intelligence systems, unless it has given its written consent.

17.4 If Content infringes your rights, report it to the address of article 20.

Article 18 — Personal data

18.1 The Publisher processes your personal data to provide you with the Service, as explained in the privacy policy, which you can read at any time on the Site. Accepting the Terms of Use does not amount to consent within the meaning of the General Data Protection Regulation: when a processing operation is based on your consent, your consent is requested separately, and you can withdraw it as simply as you gave it.

18.2 From the Launcher, you can export your data and delete your Account (or, if the Launcher is closed to you, by writing to support@afterlife-game.com, article 4.4); for your other rights, write to the same address. You can also lodge a complaint with the Commission nationale de l'informatique et des libertés (CNIL), the French data protection authority.

18.3 The Launcher and the Client record certain information on your device (your session, your settings): Annex A of the licence agreement describes it.

Article 19 — The messages that the Publisher sends you

19.1 The Publisher writes to you at the address of your Account for the operation of the Service: verification of your address, reset of your password, security of the Account, significant modifications of the Terms of Use, Moderation Measures and, later, confirmation of your purchases. 19.2 The Publisher sends you neither advertising nor a newsletter by email without your prior consent, given through a separate box, never ticked in advance. You can withdraw it at any time, through a link present in each message.

Article 20 — Contacting us: single points of contact

20.1 For Players and for any person. For any question, complaint or request about the Service: support@afterlife-game.com. A person reads the messages and answers them; you are never obliged to go through a robot. Languages: French and English.

20.2 For the authorities. The authorities of the Member States of the European Union, the European Commission and the European Board for Digital Services contact the Publisher at support@afterlife-game.com, in French or in English.

20.3 Reports, challenges and security vulnerabilities: support@afterlife-game.com.

Article 21 — Complaints, mediation, applicable law and courts

21.1 Complaint. Before any other step, write to us at support@afterlife-game.com describing the problem; we answer you within thirty days at most.

21.2 Mediation. During the Alpha, which is free of charge, the Publisher sells nothing: no consumer mediator (médiateur de la consommation) has been designated. It will designate one before any sale, and its name will appear here.

21.3 You will never be obliged to go through mediation before bringing a matter before the courts, and no dispute is submitted to arbitration.

21.4 Applicable law. The Terms of Use are governed by French law. If you are a consumer who resides in another country, you also keep the protection afforded to you by the mandatory provisions of the law of that country.

21.5 Competent court. You may bring proceedings, at your choice, before one of the courts having territorial jurisdiction under the French Code of Civil Procedure (code de procédure civile), or before the court of the place where you were living at the time the contract was concluded or the harmful event occurred. If you reside in another Member State of the European Union, you may bring proceedings before the courts of the place of your domicile; the Publisher may only bring proceedings against you before the courts of the State of your domicile.

Article 22 — Miscellaneous provisions

22.1 Language. The Terms of Use are drafted in French. If they are also offered to you in another language and the two versions differ, the version that is most favourable to you applies.

22.2 Severability. If a clause is held to be null or deemed unwritten (réputée non écrite), the other clauses remain applicable.

22.3 Tolerance. The fact that the Publisher does not rely on a clause one day does not prevent it from relying on it later.

22.4 Transfer of the contract. The Publisher may transfer the contract to another person who takes over the operation of the Game — in particular the company Reloaders, which the creator of the Game is setting up for this purpose —, provided that your rights are not diminished as a result. It informs you at least thirty days in advance, and you may terminate the contract free of charge if you do not wish to follow this transfer.

22.5 Distribution platforms. If you access the Game through a distribution platform (for example Steam), its own terms also apply to your relationship with it, in particular to the payments that it receives; the Terms of Use continue to govern your relationship with the Publisher and your use of the Service.

Article 23 — Your health

23.1 Some people may have an epileptic seizure or lose consciousness when exposed to certain flashing lights or certain patterns, including while playing a video game, even without any prior history. If you, or a member of your family, have already shown such symptoms, consult a doctor before playing. Stop playing immediately and consult a doctor in the event of dizziness, a disturbance of vision, muscle twitching, a loss of consciousness or a feeling of being unwell.

23.2 Play in a well-lit room, at a good distance from the screen; avoid playing when tired or after too short a night; take a break of ten to fifteen minutes every hour. Parents: accompany your children in their gaming.
